Trademark Publication in Turkey

Publication of a trademark is an important step in the registration of a trademark.

Primarily the publication of a trademark application provides the public a chance to file a trademark opposition which can be the biggest obstacle to trademark registration.

Basically a trademark is published for third party oppositions after the Trademark and Patent Office determines that the trademark application complies with all applicable laws, rules, and regulations.

Countries publish trademarks on a platform in accordance with the laws and regulations of the country concerned. In Turkey, trademark applications are published in the Turkish Trademark Bulletin, after they are approved for publication.

The Bulletin

The Turkish Trademark Bulletin of trademark applications is published online by the Turkish Trademark and Patent Office once in every two weeks. Also the Bulletin can be accessed for free from the Turkish Trademark and Patent Office website. The Bulletin can be downloaded from the Turkish Trademark and Patent Office’s official website as long as the site is accessed from your country. Additionally, the document can be saved as PDF (portable document format).

As the hardcopy version of the Bulletin has been abandoned, paper version of the Bulletin is not available.

Also the language of the Bulletin is Turkish and there is no English version.

The Bulletin contains a list of the marks and details of each trademark published along with International Trademark Registrations.

The marks are published in colour, provided that the colored logos are listed on the last pages of the Bulletin.

Trademark Publication and Marks in the Bulletin

Trademark applications are published on the Bulletin with the following details;

  • trade mark logo
  • trademark application number
  • IR (international Registration) number
  • application date
  • trademark name
  • nationality and name of the applicant
  • name of the trademark attorney
  • Nice class and specification of goods & services
  • Refused goods and services if the application is partially rejected

In line with the Turkish Data Protection Law that was enacted in anticipation of GDPR, the address information of an individual applicant is no longer published in the Bulletin. The address information of legal entities still continues to be published.

However, the Bulletin does not cover the history of the mark. Once the application is published, you can view the trademark history and check the trademark status from the trademark webpage via trademark search section by entering either the application number or trademark name. Moreover It is possible to change the page language settings to English.

Where the publication of the application contains a mistake or error attributable to the Office, the Office corrects the mistake or error on its own initiative or at the request of the applicant. For corrections the Trademark Office publishes the trademark application on the additional Bulletin disregarding the former.

Opposing a Published Trademark

A trademark application is published in the official Bulletin for a period of two months, for any possible oppositions of the third parties. Any member of the public, individual or legal entity, who thinks they will be harmed by the registration may initiate trademark opposition proceedings under the Turkish Trademark Law.

In order to prevent a trademark application to be registered by an applicant, the aforesaid third party has to file an opposition against the application.
