Law No. 6769 on Industrial Property in Turkey

Intellectual Property Law in Turkey is mostly harmonized with European Union laws and regulations aiming to ensure proper implementation of European legislation. 

In this framework, Turkey is signatory to the following treaties, conventions and protocols; Paris Convention, Berne Convention, Madrid Protocol, Hague Agreement, PCT (Patent Cooperation Treaty), European Patent Convention. 

Legislation on Intellectual Property Law in Turkey is basically based on two Codes. These are Industrial Property Law No. 6769 (the IP Code) and the Law on Intellectual and Artistic Works No. 5846. According to the principles set forth in the Turkish Constitution, these laws are implemented in line with the international agreements and protocols mentioned above. 

In Turkey, the Law No. 6769 on Industrial Property regulates trademark, patent, utility model, geographical indication and design rights respectively. 

The IP CodeNo. 6769 

The name of the IP Code is “Industrial Property Code”. The Law entered into force on January 10, 2017, on the same date as its publication in the Official Gazette. 

The Code repeals the IP related decree laws numbered 551, 554, 555 and also 556.  

It introduces important changes to the Turkish intellectual property system. Moreover, some of the regulations of the Turkish Trademark and Patent Office are abandoned in accordance with the IP Code. 

Also, it changes the name of the Turkish Patent Institute as “Turkish Patent and Trademark Office” which is an essential amendment brought by the IP Code. 

Principally, the IP Code covers all industrial property matters pertaining to trademarks, patents, utility models, designs and geographical indications.
